Medical Marijuana Program - Delaware Health And Social Services

Physicians now have another option when certifying medical marijuana patients. The CBD Rich patient card can be utilized for the traditionally approved debilitating conditions and for the treatment of anxiety.The treating physician can elect the CBD Rich card whenever they feel it is an appropriate option, but it must be used for the treatment of anxiety.

** Patients issued the CBD Rich card are limited to purchases of products containing low concentrations of THC and elevated concentration of CBD.

Compassionate Use Card

Starting March 1, 2020, Delaware licensed physicians may now certify a patient with a serious debilitating medical condition who previously did not qualify for medical marijuana treatment under the Medical Marijuana Program through the newly created "Compassionate Use Card" (CUC). The CUC is a card issued by the Department that authorizes the use of medical marijuana under specific conditions including:

The patient has a severe and debilitating condition;

- All current standard care practices and treatments have been exhausted and have been ineffective, or the side effects are prohibitive with continued use; - The certifying physician will re-evaluate and document the efficacy of medical marijuana treatment by following the intervals directed in the program regulations; - Certifying physicians must develop a comprehensive treatment plan for patients at risk of abuse or misuse of marijuana as a treatment option; - The physician will provide scientific support showing potential for the patient to benefit from using medical marijuana. The Department will review pertinent research articles or peer reviewed studies for evidence that medical marijuana may provide some benefit for the condition.

Automated Renewal Notification

Delaware Medical Marijuana Program participants who have registered a valid email address with the Office of Medical Marijuana will receive a notice when the patient card is within 90 days of expiration through the BioTrack notification system. The notice will provide patients with renewal information. Patients who do not have a registered email address are encouraged to provide a valid email address when they renew their card.

Health Care Practioner Patient Certifications

There has been a change to the type of Health Care Practitioner that can certify patients for the Medical Marijuana Program. Advanced Practice Registered Nurses and Physician Assistants are now authorized to certify patients for the Medical Marijuana Program.

Effective July 1, 2019

The Delaware Medical Marijuana Program will add a mobile ID card which you will be able to access from any mobile phone. The MMP will continue to issue hard ID cards for the card holders who do not wish to use their phone.

You must be registered in the Medical Marijuana System before you can access your mobile ID card. Please go to https://delaware.biotrackthc.net/patients/actions/. Click on “NEW PROGRAM PARTICIPANTS” to complete your registration.biotrackthc.net/patients/actions/ and click on “NEW PROGRAM PARTICIPANTS” to complete your registration. You will need a valid email to successfully register. Once you complete the registration you will receive a confirmation email.

First Step is to log into https://delaware.biotrackthc.net/patients/actions/ from your phone.

After logging into the system you will be directed to the “OWN APPLICATIONS” screen.

In the upper right corner of the screen you will see an icon with three lines, click on this icon. After clicking on the three line icon you will see four more icons to include your name. The icons are the mobile ID, Limit Meter, Notifications and logout. Click on the first icon which looks like an ID card. Your Mobile ID will appear on your screen.

At the last Medical Marijuana Oversight Committee meeting, committee members discussed and voted on a new application fee structure which will be implemented on 1 July 2019.

- New and renewal patient applications $50.00 - New and renewal caregiver applications $50.00 - Employee $125.00 - Low Income $25.00

The Low Income Application Charge will be determined utilizing 138% of the Federal Poverty Level. If your gross household income is at or below 138%, your application fee will be $25.00. The new Low Income Charge Request Form can be seen here. Please do not submit this form prior to July 1, 2019.
