Are CBD Oils Legal In The US?

I mentioned that many states still have measures in place to prohibit the sale of medical marijuana in order to prevent it from crossing state lines and becoming available for medicinal use. Until the Farm Act was passed in 2019 at Federal level there was concern that if CBD oils were made available, how would that affect the distribution of marijuana? That concern remains, but it is permitted subject to proper licensing compliance all states must now allow low THC CBD production including the oils as hemp-derived CBD products (with less than 0.3 percent THC).
There is one thing you can do if you find yourself wondering if it is legal in the USA to possess CBD medical marijuana: call the Drug Enforcement Administration (DEA). DEA is the federal agency that enforces the Controlled Substances Act. They will have the answer to your question.
In general, if someone uses a drug or substance for any reason, it is illegal to distribute it to another person if the reasons for use are for medicinal purposes. The laws regarding possession of controlled substances are different in each state. Even so, there are some basic principles that are universally applicable. One of these principles is that when a person intentionally possesses a controlled substance, it is illegal.
When a doctor prescribes or recommends medical marijuana in order to help a patient to alleviate their pain and suffering, they have every right to do so. However, when they provide marijuana for personal use, or allow anyone else to use marijuana for personal use, then they are breaking the law.
The important point to remember is that CBD products (with less than 0.3 per cent THC) such as CBD oil are legal in all 50 states. They are not medicinal products but are sold for health and wellness purposes.
In the case of CBD oil, if you want to try the oil on yourself and it works, or you want to give it to others, then it may well be perfectly legal to do so in all states. However, if you choose to sell the oil at 3% THC content, or above 3% THC, you may be breaking the law.

To be absolutely clear, CBD oil has been thought to help people who suffer from severe medical conditions including cancer and epilepsy, and evidence is growing while still not clear enough to mean it can be sold as a medicine, in most states. But, the whole issue becomes so clouded because it is also being used for recreational purposes, and that is what is at the center of this article. CBD is not used for such purposes as it does not contain enough THC. It is derived from hemp, the same plant that grows for most commercial hemp, and the pyschoactic content is too low to mean it has any effect.
The next legal issue surrounding CBD oil is whether or not it is legal in the USA to sell it over the counter. As I mentioned previously, the DEA regulates the distribution, and you may have noticed some companies selling the oil on the internet, because licensed CBD production and sale is now permissible in all 50 states.
